-BANK TRANSFER IN ADVANCE :
In case of payment by bank transfer in advance, the shipment of the ordered products will occur only after the effective crediting on the current account of Livitalia. The transfer has to occur in 4 working days from the date of the order’s acceptance; passed these 4 days the order will be automatically cancelled. The customer assures to Livitalia to dispose of the possible authorizations to use the above-mentioned condition of payment.
- CREDIT CARD :
Buying the goods through a credit card payment, Paypal (system of payment fast and safe of the eBay group), the customer will be addressed to a Paypal website where he can complete the order and make the payment entering on his own account( putting in the e-mail address and the password) or creating a new account in an easy and fast way.
Choosing to pay by Paypal, the amount is charged directly on his credit card ( Visa,Visa Electron, Mastercard) or on prepayed card (Postepay). PayPal protects the informations of the purchaser as the financial information won’t be given out. The society of PayPal (Europe) s.à r.l & Cie,S.C.A, thanks to its well-advanced system of cryptography and of protection, PayPal assures the gratest safety of the payment and it is accepted and known all over the world. For every transaction carried out with this method of payment, a confirmation e-mail will be sent by PayPal. The amount is charged on the PayPal account at the time of the order’s acquisition. In case of cancellation the amount will be refunded on the PayPal account of the customer.
In accordance with the law article 5 of the legislative decree 22nd May 1999 no.185, the customer (if he ca be described as the “consumer” in accordance with the article 1b of the legislative decree 22nd May 1999 no.185)has the right to withdraw the contract and to give back the ordered products, without any penalty and withpoy specifing the reason, by the term of 14 working days after the delivery of the products. The right of withdrawal has to be exercised by the customer through the sending of a registered letter to Livitalia , via del Lavoro,26-63039 San Benedetto del Tronto (AP), by the term of 14 working days from the delivery of the products (at risk forfeiture). The above-mentioned comunication can be sent also by fax to Livitalia to the number 0039 0735 762102, provided that it is confirmed by a registered letter in 48 hours after the sending of the fax.
All the returns (which have to be perfectly intact and in the original packaging) have to be authorized by Livitalia, that will issue an authorization number for the return (RMA). When the customer receives the RMA number, he can ship back the product at his expense to this address: Livitalia , Via del Lavoro, 26 - 63039 San Benedetto del Tronto (AP). We will not accept packagings cash on delivery. Once received the products (and verified their integrity) Livitalia will provide to credit to the customer the price of the returned products (as the invoce specifies) as soon as possible, and however in 10 working days from the receiving of the goods. If it is necessary, Livitalia will deducte the amount of the carriage, that is always at the expense of the customer.
The right of withdrawing (article 5 of the legislative decree 22nd May 1999 no.185) can not be exercised by the customer if the bought products have been used (or damaged) from the customer himself.
The right of withdrawing doesn’t apply to customers who buy for their own working activity( for exemple capital use, resale,etc..) and therefore who communicate to Livitalia his VAT number.
The right of withdrawing is not available in the following situations:
-purchase of the packed products, whose original packaginghas been demaged by the cusomer;
-if the bought products are “custom-made” and/or based on specific characteristics wanted by the customer
-if the products are on special offer in the “OUTLET” area, beacause coming from a trade show, photograph set and Show-room of the producer and for this reason being part of the category “used goods”.
-during the period of the withdrawing the customer is in charge of the good as a keeper. In case of demage or distruction of the product during the customer’s safekeeping, the right of withdrawing will decay.
- Withdrawal after shipment of the goods and non-collection of the goods shipped:
In case of notice of withdrawal sent after the shipment of the goods with consequent non-collection, the costs for the return of the goods and the costs of storage due to the transporter will be charged.
